Court EU: IND fee ‘excessive’
The European Court of Justice ruled on 26 April 2012 that the Netherlands (Immigration and Naturalisation Service, IND) charges a fee to foreigners, who apply for a long-term resident permit in the Netherlands under Directive 2003/109, which is “excessive and disproportionate” and is liable to create an obstacle to the exercise of the rights conferred by the Directive 2003/109 (C-508/10, par. 79). According to the Court, the Netherlands has failed to fulfil its obligations under this directive.
