Change in IND procedure for DAFT and Japanese Trade Agreement applications

As of August 1, 2023, the IND has (temporarily) changed its procedure for processing applications filed under the Dutch American Friendship Treaty (DAFT) and the Japanese Trade Agreement.

In principle, under the new working method, the IND no longer checks whether the applicant meets the specific conditions for the residence permit. Specific conditions are for example, a registration in the Chamber of Commerce and the investment of the required capital in the company.

The IND does still check whether the applicant meets the general conditions for residence. So for example, whether the applicant doesn’t pose a threat to the public order or national security. If there is reason to do so, the IND can still request that the applicant meet all specific requirements for the permit.

Tougher control during renewal procedure

Within 6 months after the residence permit has been issued, the applicant must meet the specific conditions for the DAFT or the Japanese Trade Agreement residence permit. If the applicant does not do this (on time), the residence permit can be withdrawn (with retroactive effect).

From now on, the IND will check whether the specific conditions of the residence permit have been met during the extension process. It’s therefore important to make sure you continuously meet all the conditions for the first residence permit.

UPDATE

The IND informed us on September 22, 2023 that the ‘old’ working method will be used again from September 13, 2023 onwards. This means that all documents must be present before the IND can make a positive decision.
