Compliance: no warning
The Employment of foreigners Act (Wav) prescribes that also a first violation of this Act has to be sanctioned. The High Administrative Court confirmed this again in her judgment of 2 March 2011 (201007472/1). The High Administrative Court also rules in this judgment that even though a company did not have any financial benefit by violation of the Wav, this is not a reason to mitigate the fine.
