Fines for violation Act on Employment of Foreigners lowered
The High Administrative Court has recently ruled that the fines for violation of article 15 of the Act on Employment of Foreigners are to harsh. The fines are now reduced from € 2,250 to € 1,500 per violation. Article 15 contains several administrative obligations for employers working with non-EU employees. These obligations include keeping a copy of the passport in the administration and forwarding this copy if the employee is seconded. The fines for these violations were raised in 2013. The High Administrative Court now rules that this raise was not necessary to deter violations.
Earlier the High Administrative Court held that the fines for violation of article 2 of the Act on Employment of Foreigners (illegal employment) were also to harsh. The fines were reduced from € 12,000 to € 8,000.
