High Administrative Court: Compliance judgement
The High Administrative court ruled in the judgement of 1 September 2010 (nr. 2010003844/1) that: the fact that the building project was unique in the Benelux, and that special expertise was needed for the building, is not a circumstance to mitigate the fine imposed for employment without work permit by three Americans. The district court had ruled that these circumstances were a reason to mitigate the fine with 50 percent.
The High Court also ruled that the fact that work permits for these three Americans were issued after the visit of the Labour Inspection is also not a reason tot mitigate the fine.
