Brexit: After 1 October transition period of 1 year for British nationals in the Netherlands

20 september 2021 British nationals in the Netherlands can apply for a residence document under the Withdrawal Agreement until 1 October 2021. After October 1, 2021, the grace period will end. The residence status of British nationals who have not yet applied for a residence document after 1 October 2021 then changes from legal foreigner to illegal foreigner. The Dutch Secretary of State has indicated that by 1 October 2021, approximately 2000 British nationals in the Netherlands have not yet applied for a residence document. That has far reaching consequences for this group.

However, the State Secretary has indicated that after 1 October 2021 there will be a transition period of one year for Britons who apply for a residence document after 1 October 2021 on the basis of the Withdrawal Agreement.

This application for a Brexit residence document after 1 October 2021 will be assessed by the Immigration and Naturalization Service (IND) on the basis of the conditions set out in the Withdrawal Agreement. If the conditions are met, the IND will issue a Brexit residence document. Not only is a residence document issued, also the status of illegal foreigner changes back to legal with retroactive effect. Resulting in the residence status never have been illegal.
