New regulation for employees of start-ups

12 August 2019 In the summer of 2020 a new regulation for employees from outside the European Union of innovative start-ups will enter into force. This new regulation is meant to make it easier for start-ups to employ international talent. The current highly skilled migrant program is considered as a barrier. The salary threshold of the highly skilled migrant program is to high. The Netherlands Enterprise Agency (RVO) will assess the start-up that intends to make use of this new regulation. The following conditions will apply.

  • The financial situation of the start-up must be as such that the highly skilled migrant salaries can not be paid (yet).
  • The start-up can not have more than 15 employees.
  • The start-up can attract a maximum of 5 employees through this regulation.
  • The employee of the start-up must have or receive an interest in the company (e.g. through shares, or share options).
  • The employee must earn at least the salary based upon the ‘search year’ permit. In 2019 this threshold is € 2,364 gross per month.
  • There will be no condition with regard to education.
  • The start-up can make use of this regulation for a maximum period of three years.
