IND legt boete op bij overtreding Vreemdelingenwet

Bij emigratie naar Nederland krijg je als vreemdelingen te maken met de Vreemdelingenwet. De IND (Immigratie en Naturalisatiedienst) kan een boete opleggen aan de werkgever van een vreemdeling indien die werkgever zijn verplichtingen op grond van de Vreemdelingenwet niet is nagekomen. De werkgever heeft drie plichten: een informatieplicht, een administratieplicht en een zorgplicht.

Niet naleving van deze plichten levert bij een eerste overtreding een waarschuwing op. Bij een tweede overtreding binnen 24 maanden een boete van EUR 3.000 en bij een herhaalde overtreding binnen 24 maanden na de eerste overtreding een boete van EUR 4.500. Bij ernstige schendingen kan meteen een boete worden opgelegd.


De informatieplicht ziet op de verplichting van de werkgever om relevante wijzigingen te melden aan de IND (Immigratie en Naturalisatiedienst). Dat zijn onder andere: beëindiging van het dienstverband, indien de werknemer niet meer voldoet aan het looncriterium, de werknemer een andere functie krijgt, de werknemer verhuist, of de werknemer terugkeert naar zijn land van herkomst. De werkgever is verplicht om deze wijzigingen binnen vier weken te melden aan de IND.


De werkgever is op grond van zijn administratieplicht verplicht om alle relevante gegevens met betrekking tot de werknemer tot 5 jaar na beëindiging van het dienstverband te bewaren. Dat zijn in ieder geval een kopie paspoort, verblijfsvergunning, arbeidsovereenkomst, loonstroken en tewerkstellingsvergunning.

De zorgplicht van een werkgever van een kennismigrant ziet op een zorgvuldige werving en selectie van de vreemdeling, en dat de kennismigrant bij indiensttreding door de werkgever op zijn rechten en plichten wordt gewezen. De werkgever moet op verzoek van de IND kunnen aantonen dat hij daaraan heeft voldaan.

Ook is de werkgever verantwoordelijk voor de terugkeer van de vreemdeling. Indien een vreemdeling binnen een jaar nadat het dienstverband tussen werkgever en de vreemdeling is beëindigd, illegaal in Nederland wordt aangetroffen, kan de IND bepaalde uitzettingskosten op de voormalige werkgever verhalen.
