Diensten verrichten in Nederland vanuit een andere EU lidstaat

Het vrij verkeer van diensten betekent dat ondernemingen, die gevestigd zijn in een lidstaat van de Europese Unie, de Europese Economische Ruimte of Zwitserland, hun werknemers voor de duur van een opdracht naar Nederland uitzenden.

Een tewerkstellingsvergunning (TWV) is niet nodig, ongeacht de nationaliteit van de werknemer. Dienstenverrichters kunnen elke werknemer inzetten bij het verrichten van diensten in een andere EU lidstaat, ook de werknemers die niet de nationaliteit hebben van een lidstaat van de Europese Unie. Dit is een algemeen aanvaard beginsel sinds het Vander Elst arrest van het Hof van Justitie van de EU. De Nederlandse regering heeft bepaald dat vooraf moet worden genotificeerd waar en welke diensten zullen worden verricht.

 

Tewerkstelling

Twee dagen voorafgaand aan de tewerkstelling in Nederland moet dit digitaal door de EU dienstenverrichter worden gemeld bij de Sociale Verzekeringsbank via het online meldloket van de SVB. Het in Nederland gevestigde bedrijf dat de opdracht heeft gegeven tot het verrichten van de dienst (dienstenontvanger) moet van de EU dienstenverrichter een afschrift ontvangen van de melding die bij de SVB is ingediend. De in Nederland gevestigde dienstenontvanger moet controleren of de gegevens die zijn opgenomen in de melding correct zijn.

Plichten

Hoewel er geen tewerkstellingsverguning is vereist, gelden er sinds de inwerkingtreding van de Wet arbeidsvoorwaarden gedetacheerde werknemers in de Europese Unie (WagwEU) op 18 juni 2016 een flink aantal plichten. Deze plichten gelden voor de buitenlandse opdrachtnemer én de in Nederland gevestigde dienstenontvanger (opdrachtgever). Niet naleving van deze online meldplicht door de EU dienstenverrichter wordt beboet met een boete van EUR 1.500 per werknemer, indien het 1 tot 9 werknemers betreft. Dit bedrag wordt verhoogd naar EUR 3.000 per werknemer indien het 10 tot 19 werknemers betreft. De boete wordt EUR 4.500 per werknemer indien er 20 of meer werknemers de dienst verrichten in Nederland.

De dienstenontvanger (opdrachtgever) in Nederland heeft de verplichting om via hetzelfde online meldloket  van de SVB uiterlijk 5 dagen na aanvang van de werkzaamheden aan de SVB te melden of de EU dienstenverrichter bij de melding alle gegevens correct heeft ingevuld. Niet naleving hiervan levert de diensterontvanger een boete op van EUR 1.500.

Let op: deze meldplicht geldt ook EU onderdanen die vanuit een bedrijfsonderdeel in een andere EU-lidstaat naar een concernonderdeel in Nederland worden gedetacheerd. Niet naleving van hiervan kan worden beboet met EUR 1.500.

De uitgezonden buitenlandse werknemers maken aanspraak op de Nederlandse wet voorzover het gaat om de ‘harde kern’ van de arbeidsvoorwaarden. Die harde kern betreft een salaris volgens de algemeen verbindend verklaarde CAO-bepalingen, regels omtrent werk- en rusttijden, vakantiedagen, en gezondheids- en veiligheidsnormen.
