Extension of the Temporary Protection Directive for Ukraine until 4 March 2028
The Council of the European Union has decided to extend the Temporary Protection Directive (hereinafter:TPD) for people who have fled Ukraine due to the war until 4 March 2028. The IND has a very informative website describing the conditions for stay and the rights.
Those who already have temporary protection
Displaced persons from Ukraine who already had temporary protection before 5 August 2026 will automatically retain this protection until 4 March 2028. This means they may stay and work in the Netherlands until that date. They will also retain their entitlement to services associated with temporary protection, such as accommodation, education, and medical care.
New conditions for new applications
For new applications submitted from 5 August 2026 onwards, persons who are subject to military service in Ukraine must be able to demonstrate that they have fulfilled their military obligations or that they are exempt from them.This new condition does not apply to those who join a family member who already has temporary protection under the Temporary Protection Directive (TPD).
Important: previous protection in another EU country
Since 15 June 2026, the IND has been applying stricter rules to displaced persons from Ukraine who have already had temporary protection in another EU Member State (Dutch). In principle, they will not be granted new temporary protection in the Netherlands. The IND may deviate from this in cases involving compelling reasons, such as medical circumstances or family in the Netherlands, provided that the temporary protection in the other Member State is terminated.
